The Impact of International Terrorism on the Liability of the Air Carrier

Abstract:

The study aims to determine the civil liability of the air carrier for damages resulting from terrorist incidents and the legal consequences of those accidents in the field of air transport. This study relied on the descriptive approach to examine the problematic of the extent to which the air carrier can be held accountable for terrorist incidents that occur during the air transport operation, based on international conventions and international court rulings regarding cases of compensation for the injured for terrorist incidents in the field of air transport.
The study reached several conclusions, the most important of which is that the air carrier is responsible for terrorist incidents in the event of failure to take the necessary measures to prevent them and after the occurrence of these terrorist incidents. It also presented a set of recommendations that the researcher considers necessary to ensure the proper determination of responsibility of the air carrier for damages resulting from terrorist incidents.
