The Situation Under Electronic Surveillance in the Algerian Punitive Policy

Abstract:


The electronic monitoring system which uses an electronic bracelet is a modern technology in the realm of criminal policy, and a ready alternative to implementing freedom-taking penalties that would reduce crimes, contribute to the rehabilitation of offenders, and lessen the negative impacts of the traditional format of punishment, which became incompatible with its contemporary purpose. For this reason, the Algerian legislature has developed this procedure under the Act 18/01 which amends Act 05/04, and which includes the law of prisons regulation and social rehabilitation of detainees.
This law was part of the implementation of the reform programme and the modernization of justice sector, where Algeria is the first Arab country, and the second African country, to use this modern method that aims mainly to streamline punishment, to ensure the rehabilitation of the convicted, and to prevent him from returning to crime by serving the sentence outside the walls of penitentiary institution.
This study aims to analyze the 18/01 Act provisions and to assess the electronic monitoring experience in Algeria and its capability of reducing crime.
