Beneficiaries of the Social Security Benefits on Behalf of the Insured – A Comparative Study between Egypt and Kuwait

Abstract:

The purpose of this paper is to explain the principles of law and general rules that must govern the insurance system for the insured pensioners, whether in the State of Kuwait or in the Arab Republic of Egypt, in terms of the scope of application, conditions of entitlement and continuation, provisions of this insurance, cases of suspension and abatement, and the administrative authority that will apply it. Attempting to reach a comprehensive and integrated legal system that meets the desired ends and the objectives for which the social insurance system was legislated the artical compares the Egyptian & Kuwait related laws.
This paper is divided into three Chapters. Chapter One is dedicated for the identification of the persons who are subject to, and beneficiary of, this system in accordance with the Kuwaiti legislation. Chapter Two explains the conditions for accrual of this insurance and the scope of its application in Kuwait & Egypt. In chapter three, some judicial and practical applications for the beneficiaries of the insured’s pension are provided. The article concludes with some recommendations to avoid the defects and flaws of the Egyptian and Kuwaiti laws on insurance of death.
