Some Forms of Legal Protection during the Covid-19 Pandemic

Abstract:

This study deals with some forms of legal protection during the Covid-19 pandemic, which has affected the entire world. Its impact was not limited to the health, social and economic sectors, but rather extended to legal aspects and whether the law achieves the required protection for individuals in society in light of the Corona pandemic.
This study examines the protection that the law provides to individuals in the state regarding a number of issues raised by the pandemic. The study examines – in a descriptive and analytical manner – the extent to which the law protects stakeholders against extinctive prescription that occurred during the compulsory public holiday due to the pandemic, and the tenant in the lease contract, and then finally to the extent to which there is protection for individuals against the state’s use of the community immunization strategy.
The study concluded that the terms of limitation must be considered again and acknowledging its suspension in the case of force majeure such as the Covid-19 pandemic, which prevented stakeholders from claiming their rights. It also concluded that the tenant should be exempted from paying the rent whenever the government’s decision to shut down the state caused him to be denied the intended interest from the lease, in addition to not ruling on the eviction of the tenants when they stop paying the rent during the closing period.
