Ensuring Compensation for Damage Caused by a Nuclear Accident in Jordanian Law

Abstract:
This study deals with ensuring compensation for damage caused by a nuclear accident in Jordanian law represented in the Vienna Convention on Civil Liability for Nuclear Damage and related texts. The researcher explained that Jordan’s adoption of the Vienna Convention on Civil Liability for Nuclear Damage contributes significantly to this goal by facilitating the establishment of this responsibility and providing guarantees that the injured person will receive compensation.
However, it was clear to the researcher that this Convention and some of the sporadic legislative texts (regardless of their importance) do not guarantee the effective protection of the rights of those affected by nuclear accidents. The Convention left a range of issues for Member States to regulate under their own laws, which are not covered by existing legislative texts.
Therefore, a special law on liability for nuclear damage must be developed which would complement this legal regulation, in particular to determine the scope of compensable nuclear damages and the limits of financial liability of the operator, regulating the issue of insurance of civil liability for nuclear damage and the scope of State intervention in the protection of the rights of those affected by nuclear accidents.
