Good Faith Functions In Civil Transactions of the Emirati law No. (5) For the year 1985: A Comparative Study

Abstract

The ethical rules are considered the fundamental foundation of the legal basis; they distance it from abstraction and render it flexible with scalable application. Perhaps Good Faith is one of the most important ethical rules comprised in some of the provisions of the Emirati Civil Transactions Law, and a legal obligation on each trader to be observed in their financial transactions. Nevertheless, by reviewing the provisions of the Law, the functions of Good Faith differ from one instance to another, which requires identifying said functions accurately and explaining the criteria by which each function of Good Faith works within the Civil Transactions Law.
