Abstract:
This article addresses the nature of patents and the conditions of its grant in the nominal and objective forms. It also explores the historical development of patent protection in the framework of the national and international laws, especially under the Agreement on Trade-Related Aspects of Intellectual Property Rights (TRIPS).
Furthermore, the article explains patent regulation in Kuwait under Law No. 71 of the year 2013 related to the adoption of the patent protection law of the GCC. This law is believed to be a valid contribution by Kuwait to meet the ambitions of the GCC in enhancing scientific and technical cooperation among GCC states.
The article is divided into two parts: the first is dedicated to the definition of patents; while the second investigates the historical development of patent protection in national laws and international agreements.
