Public Employees’ Complaints Presented to the Public in Light of Administrative Judicial Jurisprudence: A Comparative Study

Abstract:
This research addresses the issue of public employees presenting their complaints to the public, considering the widespread availability of public publishing media, such as social media, newspapers, and print, as well as electronic magazines. It explains the nature and concept of this topic, its legal basis, and the restrictions imposed on it, using a descriptive, analytical, and comparative approach. It also explains the legal texts, and the administrative and constitutional judiciary rulings related to the subject which are described and analyzed in the light of the objective standards and concepts established in Islamic jurisprudence, and on the basis of striking a delicate balance between the rights and freedoms of the public employee on the one hand, and the nature and requirements of public office on the other.
The study concluded that a public employee›s right to present their grievances to the public is a right based on freedom of opinion and expression, guaranteed internationally through international conventions, and locally through the constitution, laws, and court rulings. This right is bound by general restrictions, including democratic principles, the constitution, the law, and non-abuse of rights. It is also bound by respect for superiors and non-disclosure of official secrets.
