Status Requirement for Inspecting Marine Vehicles and Vessels: A Study of the Jurisprudence of the US Supreme Court

Abstract:
This study deals with the issue of standing in pleading before the courts to invalidate a vehicle inspection, in the United States of America. It adopted the analytical method in discussing the subject and concluded that the basis for acquiring standing to plead invalidating a vehicle inspection is proven to the owner of the vehicle or its legal possessor. Despite this, the Supreme Court of the United States of America also granted this status to anyone who is legally present inside the vehicle, even if he does not possess it. The study also concluded that placing movables inside the vehicle would give status to the owner of those movables, even if he was not found inside the vehicle at the time of the inspection.
