The Legal System of the Public Economic Organizations and Institutions in the State of Kuwait

Abstract:

The study examines the Legal System of Economic Public Utilities, EPUs and economic public establishments and authorities in the State of Kuwait. It is of importance to point out that EPUs exercise or govern economic ( i.e. commercial, industrial, financial, or agricultural) activities.
Moreover, the research examines EPUs within related Kuwaiti laws and court judgments. It raises significant questions regarding the legal provisions that govern EPUs in terms of function and formation, legal relationships between EPUs and its members, and legal relationships between EPUs and the central government. The study questions whether EPUs are subjected to the public law, or governed by the private law based upon their economic nature. Accordingly, the results would determine the jurisdiction of the courts in concern.
