Dreadful fall of Principle’s of International Humanitarian Law?

Once again all international law institutions and society find themselves paralyzed, disabled, and unable to move against the wave of “savagery crimes” which witnessed by many countries around the world, as the human conscience almost entirely miss the sense of pain and suffering of the tortured and oppressed people, and to interact with them and help them, despite the obvious justice, which reveals the depth of law crises and who is implementing it, even the human conscience crises in general during this phase of human history.
Many researches in the field of international humanitarian law have thought that the repeated Palestinian massacres were by the occupation forces, which claimed millions of dead, wounded and refugees. And the Iraqi occupation of Kuwait in 1990, then the genocide in Rwanda located in Africa 1994, which witnessed in only one hundred days killing of eight hundred thousand people (800,000). Many researches in the field of international humanitarian law have thought that the repeated Palestinian massacres were by the occupation forces, which claimed millions of dead, wounded and refugees. And the Iraqi occupation of Kuwait in 1990, then the genocide in Rwanda located in Africa 1994, which witnessed in only one hundred days killing of eight hundred thousand people (800,000).
Then, Srebrenica massacre witnessed by Bosnia and Herzegovina, located in the heart of Europe in 1995, which killed more than eight thousand men, children and others, that they thought would be the last massacre the world will witness during the recent period. As they thought the negative role of the United Nations Organizations either regarding the occupation of Palestine and the occupier’s crimes or regarding Srebrenica crime where no action from the Dutch soldiers in charge of the protection of the safe zone to stop the massacre. All that will be a strong incentive to reconsider the policies and procedures relating to international and regional organizations for enhancing international peace and security and to protect human rights in the entire world as stipulated in different materials in United Nations charter and other subsequent international and regional conventions and declarations.
It seems to us that those suspicious have misplaced or may have been overly optimistic. Today, human society is witnessing in several Arab and Muslim countries daily tragedies and massacres as in Syria, where the dead more than half a million, number of displaced people exceeded twelve million according to United Nations Reports and its Statistics. That was after five years from the beginning of the popular revolution which demanding freedom, dignity, democracy and political participation. As the human society witnessed the expansion of what called “Savaging Crimes” the new- old, which launched by the militias of “Daesh” (ISIS) which is rejected in thoughts and practice as well as suspicious in its origination and circumstances through the slaughter of hostages, burning and mistreatment of women and explosion of institutions and attacking innocent people in different capitals around the world, in addition to other actions describes as crimes against humanity. Also witness in parallel with previous actions the siege of cities policy and their destruction, starving innocent civilians, bombing with international forbidden weapons and hiring foreign armies looking for their extermination and displacement, which all war crimes requiring international procedure to face who is responsible for that.
At the time when the world witness the objective and military coalition among a large number of countries to face terrorist “Daesh” (ISIS) organized crimes, but it is the silence in facing other criminal practices, which claim the lives of daily thousands dead, injured and displaced, which raises questions about standards and the integrity of its applications and the International humanitarian Law and about the legality of the political insurance for that organization committed that crimes against humanity.
These actions pose a threat to International peace and security as stated in the Charter of United Nation and other International institution in important regions of the world as it is in breach and violation of fundamental principles of human rights and dignity which need urgent action by the international community and the institutions of law to direct the movement and activate mechanisms to keep peace and security. As the appearance and continuous of the new savages crimes which is a threat to human society and the human civilization and contrary to human nature and inherent tendency toward the mercifully.
Undoubtedly that all human societies without exception agree on the importance of the rule of international peace and security for any society it is important to recall that the realizing of these values and goals shared responsibility between nations, governments, organization, institutions and individuals. As well as the international jurisprudence to concentrate on these new challenges and ways to address them in order to exert more pressure on international institutions to achieve international justice value by activating principles and rules of international law and to carry out their duties in this important stage of human history.
