Constitutional and Legislative Tools to Counter the Covid-19 Pandemic in the Kuwaiti Legal System

Abstract:

The emerging Coronavirus pandemic is one of the most serious crises facing mankind at the present time. This epidemic threatens public health worldwide and was considered a global epidemic by the World Health Organization due to the rapid spread of the disease and the lack of vaccines needed to treat it. This has led countries around the world, including the State of Kuwait, to take the necessary measures to confront this epidemic and limit its spread.
There is no doubt that the most important measures among these are the legal procedures adopted by the state. This research presents the most important constitutional and legislative tools adopted by the Kuwaiti legal system to confront the Coronavirus pandemic, including general control legislations of both types: legislative control and administrative control regulations, and their role in confronting this epidemic. The research will also present the constitutional tools that the state can resort to in responding to the crisis, such as declaring the state of martial law, issuing authorization regulations whenever deemed necessary.
