The Extent of Financial Copyright Protection of Authors in Audio Presentation for the Whole Protected Work to the Blind: A Comparative Study Between the Jordanian Law and International Agreements

Abstract:

While the general principle in exercising the right of public performance of third parties to require the written permission of the author or his successor, this research addresses the legality of the audio presentation of the whole protected work for the blind without the permission of the author or his successor.
One of the most important results of this research is that: the right of the blind to access an audio presentation of protected works without obtaining the permission of the author or his successor is based on principles endorsed by numerous international conventions and international bodies. However, the Jordanian legislator does not allow such audio presentation unless the purpose is purely educational and not paired with any other profitable goals, in contrast to many international conventions on copyright that permits audio presentation for the blind even for non-educational purposes.
This study has two sections; the first defines the exclusive right of the author to present his work to the public, and the second discusses the legal base for the legitimacy of audio presentation of the whole protected works for the blind without the author’s, or his successor’s permission.
