International Responsibility for Violating Environmental Protection Rules During Armed Conflicts

Abstract:
The environment is often considered a vital target during armed conflicts, where hostilities are directed at it directly. The parties to the conflict do not respect the rules of protection guaranteed for the environment in international law, especially with technological and scientific development as well as the development of weapons, including nuclear weapons and weapons of mass destruction, and with reference to Rules related to international responsibility in international law There is no doubt that it violates the rules of the environment during armed conflicts in the event of a breach of international obligations. Therefore, and since the protection of the natural environment during armed conflicts is the goal of the study, which is of particular importance in light of the legislative shortcomings and ineffectiveness of the rules of international humanitarian law, we will try in this research to shed light on the legal rules applicable to protecting the environment during armed conflicts, the extent to which it is possible to determine the international responsibility of the state violating international law of the environment during armed conflicts, by looking at the concept of international responsibility for environmental crimes as well as the foundations and conditions of international responsibility for environmental crimes, as well as we will study the international judicial mechanism in protecting the environment to determine criminal responsibility against the perpetrator of environmental crimes as a war crime.
